What knowledge management challenges do law firms face?

Legal knowledge in a law firm is not just commentaries and codes on the shelf, but also experience and information gathered from handling hundreds of cases. The big challenge is that this knowledge is sometimes scattered: some in lawyers’ heads, some in files on disks, some in emails. Law firms often have extensive archives - hundreds of gigabytes of documents: lawsuits, contracts, legal opinions. The problem is that it’ s hard to reuse this when there are no good search and organization tools. How many times does it happen that a lawyer prepares an opinion on a topic that a colleague already analyzed a year ago, but he doesn’t know about it? Or that there is a great contract template somewhere in the company, but the new employee has no idea where to look for it? This results in duplication of work and a failure to use the potential of accumulated information. Another problem is knowledge silos: in large law firms, individual departments (e.g., tax, litigation, corporate) have their own databases of documents and do not share them effectively with others. It also happens that knowledge leaves with the employees - as an experienced lawyer leaves, he takes valuable know-how with him (in a mental sense), and the company doesn’t have it saved anywhere. Knowledge management, then , has a challenge: to capture, organize and make knowledge available to everyone authorized in the company. On top of that, there is a purely logistical challenge: lawyers have little time, so even when there is an internal knowledge base, they rarely add to it or nurture it - because the priority is the current work for the client. Finally, the timeliness of the information is also an issue - the law changes, so a certain meme from last year may be out of date, but from somewhere in the file no one will remove it, and someone else may inadvertently rely on it. So we have fragmentation, duplication, gaps and outdated data. This is where new technologies, and AI in particular, can help a lot, because they are able to automatically index large sets of documents, extract the quintessence from them, combine facts and signal changes. But before we say how, let’s summarize the challenges: the enormity of the information (and it’s still growing), the lack of a clear system to organize it, the difficulty of quickly accessing the knowledge needed, and the dependence on human memory and time. All of this means that we often “know it’s ringing somewhere, but we don’t know which church” - that is, we feel we’ve had a similar case, but have no quick way to extract the details. This is where AI comes to the rescue.

Can AI act as an in-house counsel for lawyers in a company?

Imagine that a law firm has a virtual advisor - an in-house chatbot of sorts - who can be asked about anything pertaining to the firm’s expertise: “Have we ever litigated an unpaid fee case where the client invoked the invalidity of a contract?” or “What arguments did we raise in a lawsuit against company X in 2019?”. Artificial intelligence can play just such a role. With access to the law firm’s document archive, AI can answer questions based on these documents. It’s like combining a company database with a mind that understands natural language. A lawyer doesn’t have to remember all the details from years ago - he can ask AI and get, for example, a summary of a case or found key letters from that proceeding. Such an in-house counsel can hint: “Yes, in Jan Kowalski vs. ABC Ltd. in 2019 we raised the argument of invalidity due to lack of written form (see lawsuit, paragraph 14) ”. In practice, this means a dramatic acceleration of access to company know-how. A new employee can ask the system about various formulas, previous cases, without having to wade through disk folders or ask senior colleagues (who do not always have time to translate). Also, a managing partner, wanting to prepare a proposal for a client in a new industry, could ask AI, “Have we had clients in the pharmaceutical industry and what projects have we done for them?” - and immediately knows what he can boast about. Besides, some large consulting firms are already using similar ideas: internal chatbots trained on their documents that answer consultants’ questions about company know-how. Of course, for such a consultant to work, it needs to be “fed” with data - which boils down to having digital archives (most law firms have them) and ensuring confidentiality (on-premises or private cloud solutions). The question is whether lawyers will trust AI enough to treat it as an advisor. Probably initially with reserve, but over time - seeing that it gives accurate and useful information - they will use it more and more boldly. It is worth noting that such a system does not give legal advice from outside the company’s base - it won’t replace the riser in literature or databases of external rulings, rather, it will supplement it with the perspective of the company’s own experience. It is like asking all colleagues at once: “has anyone done anything similar?”. AI will look into the company’s “collective memory” and say: yes, we did, here’s how. So to answer: yes, AI can act as an in-house advisor, slipping lawyers knowledge and documents gathered inside the firm, in an almost conversational mode, 24/7.

How does artificial intelligence help search for information in case archives?

Traditional case archives - even electronic ones - are usually folders arranged by client or signature, with dozens of documents described more or less consistently. Finding something specific is sometimes difficult if you can’t remember exactly which file it was in. AI can support in several ways. First, it can index the whole thing - that is, read all the documents and create a “map” of concepts and issues. This way, the search is not just based on file names or tags, but on the full content. So we can find cases where, for example, the name of court expert Nowak appears, even if it was nowhere written out in the title - because AI scans the content of the letters and associates them. Second, AI can understand the context of the query. If we ask: “Find all the cases where we represented defendants in a defamation suit,” a traditional search engine might not be able to do so (because what, search for the words “defendant” and “defamation” in thousands of pages?). AI, on the other hand, can know which cases were for defamation (because, looking through the documents, it recognized that they involved Article 212 of the CC or personal injury claims for statements) and in which we were on the defendant’s side. As a result, it will list 3 cases from previous years in a second. Third, AI can do automatic summaries of archived cases. Instead of reading the entire file, the system can spit out, for example, a paragraph of summary: parties, subject matter, outcome, key arguments. This is incredibly useful when you want to quickly figure out what an old case was about - instead of going through several files (lawsuit, answer, judgment), you get an essence with references to the originals. Fourth, artificial intelligence can connect facts between cases. It can notice that a certain document scrolls through different cases (e.g., a contract template or an expert’s name), and make it easier to reach all those places. This builds up a kind of networked knowledge picture, rather than just a linear archive. In practice, lawyers can use such a search engine like Google, only internally: they type in a keyword, and here pops up specific excerpts of old writings, notes or emails on a given topic. It is worth mentioning that traditionally archives are also in the form of scans (especially older paper cases). New AI systems have integrated OCR (text recognition) and can analyze even scanned PDFs or photos of documents, so what used to be a “dark zone” (because not searchable) now becomes a data source. Of course, security has to be taken care of - such a search engine should work within the company, so that confidential information is not leaked outside. But on the technical side, this is already available and in use. To summarize: AI turns the case archive from a “box full of papers” into an interactive knowledge base, where everything is within the reach of a few clicks or language queries. Thus, what used to lie fallow after a case was closed is now alive and supports further work.

Can AI analyze law firm documents to extract relevant data?

Yes, and this is one of the key applications of AI in Business Intelligence for law firms. Think of all the data hidden in documents: dates, amounts, names of entities, results of cases, arguments used, times of proceedings, etc. AI can go through documents and extract (pull out) this information. For example, it can extract information from any judgment we have in the archive: court, reference, date of judgment, result (granted/denied), amount awarded. Then the collected data can be aggregated and suddenly we know, for example: “In the payment cases we handled last year, the average time from the filing of a lawsuit to the verdict was 14 months, and the average amount won was 200 thousand zlotys.” Or, “With what legal argument did we have the highest effectiveness?” - let’s say argument A we raised in 10 cases, 8 of which we won, argument B in 5 cases, won 5, argument C in 7 cases, won 3. Such meta-analysis is now possible when AI “understands” documents and can compare them. Another example: analyzing contracts that a law firm prepared for clients. You can ask AI: “Find the scope of validity (duration of confidentiality) in all the NDAs we prepared.” Then AI scans the NDAs in the archive and can generate a list: e.g., 2 years after signing, 5 years after disclosure, indefinitely - how many were like that. This can hint at the company’s standards or if there are any unusual deviations. Another thing, AI can monitor incoming documents. Suppose we have a law firm’s email inbox, where rulings from our correspondents come in. The system can analyze these emails and immediately extract key info from the attachments - e.g., “a new judgment has arrived in case X, won, amount Y, costs awarded Z, Judge Kowalski.” A lawyer, opening the system in the morning, sees a concise picture of what new came without reading the whole thing. This greatly increases situational awareness. Finally, AI can be used to create internal reports and dashboards. Since it can pull data, why not make visualizations out of it? E.g., how many cases we handle in a given court and what our efficiency is. Or how the types of cases in the portfolio are distributed (e.g., 30% are corporate cases, 20% litigation, 50% collections). Some of such statistics can, of course, be pulled from ERP or CRM systems, but they don’t know the content of documents, so they won’t tell, for example, what legal argument is most often used, or which clauses in customer contracts raise disputes. AI analyzing the content will say that. Naturally, it’s worth mentioning anonymization and confidentiality - if we also want to use the data, e.g. to share knowledge outside the company (industry reports, etc.), AI can anonymize automatically (it will clear the names of individuals/companies). In sum, AI can turn unstructured law firm text documents into a rich set of data that can then be turned into management or subject matter expertise. It’s like picking specific numbers and facts out of the chaos to help make decisions or improve processes.

How can AI tools support the learning and development of lawyers?

AI can play an interesting role in the training and development of law firm employees. First, it can serve as an interactive trainer. A young lawyer, for example, can practice writing pleadings using AI as a tutor: he writes a piece of reasoning, and AI evaluates and prompts: “This argument can be strengthened by referring to Supreme Court decision X” or “This sentence is unclear, try to formulate it more clearly.” It’s a bit like the personalized feedback that a mentor would normally give, but here a machine can give (at least to some extent). Second, AI can generate quizzes, case studies and simulations. E.g. a legal assistant wants to test how well he knows civil procedure - he can ask the AI: “Ask me 10 test questions on civil trial evidence,” and he gets a quiz to solve. Or for the contract negotiation department: you can simulate a negotiation with AI, where AI plays the role of a demanding client or the opposing party’s lawyer. This allows you to practice arguing and reacting on the fly, without risking real harm. Third, AI can facilitate knowledge sharing internally: the information collected and indexed (as we discussed in previous sections) becomes the basis for teaching others. E.g. a new employee, instead of relying on someone to tell him everything, can use an internal chatbot and ask about typical processes, procedures in a law firm (“how does the preparation of a lawsuit look like in our firm?”, “where can I find a model investment agreement?”). This speeds up onboarding. Fourth, AI can catch knowledge gaps. If many lawyers ask a similar question to an assistant (e.g., “how to format a letter to the KRS” - because there may not be a good instruction), the system administrator can see that it is worthwhile, for example, to organize a mini-training course or provide a simple procedure. Or if everyone confuses two similar regulations, AI will note it. Finally, AI tools can support self-education - suggesting readings, for example. Given a lawyer’s preferences (e.g., he deals with data protection), the system can generate him a personalized newsletter every week with the latest legal developments and case law in that area (which AIs can do themselves - generate summaries of new laws). This is a huge help, as lawyers often complain that they can’t keep up with the news. AI can be such an R&D assistant: it constantly scans sources (whether external or internal) and feeds the lawyer with the knowledge the latter just happens to need or be interested in. As a side note, AI in the role of a teacher can also be indispensable for learning legal language - e.g. a Polish lawyer wishing to brush up on legal English can practice legal dialogues or live translations of clauses with a chatbot, getting corrections of mistakes. So in short: AI can be both a trainer, an examiner and a librarian for a lawyer. This makes the development process more efficient and customized, ultimately improving the team’s competence.

Can AI prevent duplication of work in law firms?

This is one of the more practical applications: eliminating double work. How many times in a law firm do different people independently perform a similar task without knowing it? AI - especially that for knowledge management - can counteract this. For example, if someone starts researching a legal issue, he or she could ask AI: “has anyone in the firm already dealt with this issue?”. AI will look through the archives and say: “Yes, in a 2021 memo, lawyer X analyzed this and came to these conclusions.” Then, instead of doing research from scratch, you can build on that work (updating if necessary, of course). Similarly, when creating documents: if a partner commissions a young lawyer to prepare, for example, terms of service for an IT client, the lawyer can ask AI: “do we already have some sample terms of service for IT?”. AI will find some sample ones, so there is no need to write from scratch or search the disk manually. Another situation: sometimes two lawyers work on similar letters for different clients (e.g., two divorce cases). Instead of each reinventing the wheel, AI could detect, for example: “Hey, lawyer A and lawyer B are currently writing divorce petitions, maybe they should consult or use a common template.” How is this possible? If, for example, a case management system integrates AI, it can analyze in the background what people are working on (this raises questions of employee privacy, but internally this can be disabled or enabled for those willing). However, it can be done more subtly - after the fact: AI notices that two similar documents have been created, so the next time a similar task comes up, it will toss it right away. In addition, AI can automatically integrate the results of the work. If two people have independently developed two memes on a topic, AI can merge their conclusions into one study, preventing two slightly different versions from existing. There will be one, richer one. Of course, this requires some organizing of the work - such as uploading memes to a central repository. But here AI can also help - it can itself aggregate emails or notes with the word “legal note” and save them in the knowledge base, without the “manual” hassle, so to speak. Another dimension is planning - AI could indicate to partners: “Next week, two different groups of lawyers are planning a training session for clients on the revision of labor law - maybe it’s better to do one together and save time?”. This is a more advanced application - it requires analysis of calendars and schedules - but it is viable. To recap: AI here mainly acts as a super search engine and comparator of what has already been done or is being done to point out duplicates. This way, once we do something, we use it again next time, instead of making a duplicate. In the long run, this is a huge savings - both in time and in avoiding frustration (“After all, we’ve done this before, why am I doing it again?”). With AI in circulation, this situation should happen less often.

What about data security when using AI on internal data?

Data security is a key issue, especially for law firms that handle confidential, trade-secret information. Introducing AI into knowledge and document management raises natural questions: will our data remain secure? The main risks are data leakage to the outside world (e.g., if we use a public model that “learns” from our data, won’t it become available to others) and unauthorized access (won’t someone outside the company gain access to our knowledge chatbot). The solution is to use private or on-premises solutions in the first place. That is, instead of sending data to a public cloud like ChatGPT (which is highly risky and generally not recommended for sensitive data), you can deploy AI models on your own servers or use ones that guarantee data isolation. There are already vendors that offer LLM (large language models) in closed mode - for example, OpenAI has an “Azure OpenAI” option where customer data is not used to train public models. Or open-source models that can be run inside the company’s network, and then nothing outside leaks out. Another issue: encryption and access control. Internal AI tools should have the same strong security as other IT systems in the company: database encryption, user authentication, access logs. If someone leaves the company, access to the chatbot is cut off just like email, etc. These are standard procedures, but be sure to cover these new tools as well. In addition, anonymization mechanisms can be introduced as a layer - e.g. before a document goes to AI processing, certain key personal data can be anonymized so that even as if something leaked (e.g. a database backup), it’s hard to link to real people. Finally, user awareness is key - lawyers need to know what absolutely must not be done. E.g., it is not allowed to copy into a private ChatGPT an excerpt from a confidential contract to ask for a summary - because this could potentially violate confidentiality (this data could be used to train the model). Internal training and policies need to make this clear. It’s better to provide a secure internal tool so that lawyers don’t scheme and use unauthorized ones. It’s also an interesting idea to introduce gradual adoption - first testing on non-confidential data, then gradually broaden the scope as we become sure of the security features. Bottom line: AI can be data-secure, as long as we implement it with the same care as financial or medical systems. Private instances, encryption, access control, and clear rules. Under such a regime , client and law firm data should not “leak” any more than it would in any other IT system. It’s also good to communicate this to clients - that we are using AI in a controlled way, without compromising their secrets. Transparency builds trust, because many customers may, upon hearing the phrase “AI,” immediately ask: “And will my data be safe?”. The answer: yes, because the system is cut off from the outside world and acts as an internal, closed vault of knowledge.

What are the confidentiality concerns when using AI on internal data?

Despite all the precautions, some concerns in the legal community remain - and are worth discussing. First and foremost, there is the fear of the “black box ” - AI provides answers or processes data, but it is not always clear how the result is arrived at. Lawyers like to have control and knowledge of who is seeing their data. The concern is that even if the model is internal, there may be some “back door” or vulnerabilities in it. Here, the need to audit and choose trusted, proven solutions bows out. The second concern: human error - that someone will inadvertently upload something confidential to the wrong system anyway (as I mentioned: for example, to a public chatbot). This is something we won’t eliminate completely, it can only be minimized with education and monitoring. Third: compliance with professional ethics and data protection regulations. Many jurisdictions (e.g., the U.S.) are debating whether the use of AI is compatible with the duty of attorney-client privilege. If, for example, data is processed by an external server, doesn’t that amount to disclosure to third parties? In Poland and the EU, RODO comes into play - for example, is uploading personal data to AI compatible with the purpose for which the data was collected? Perhaps the AI provider would need to be recognized as a data processor and sign an entrustment agreement with it. These formal and legal aspects raise concerns. Law firms may be concerned about whether they will violate the law or ethical standards. The answer to this may be, for example, to obtain client consent (although rather, clients expect that their data does not circulate anywhere else). So it’s better to ensure that they don’t circulate - hence the preference for on-prem tools. Another concern is stability and availability - if we start relying on AI for knowledge, and the system goes down or gives wrong answers, aren’t we making a fool of ourselves? Lawyers need to feel confidence in the tool, otherwise they won’t use it to its full potential. This is already a question of the quality of implementation. And finally, a more human aspect: some fear that if all the data is so easily accessible internally, they will lose a certain individual advantage (e.g., an experienced employee may feel that “knowledge = power,” and if AI gives this knowledge to juniors, he will become less irreplaceable). It’s not so much confidentiality as some cultural resistance. It can manifest itself in a reluctance to share documents with the system. This, too, needs to be addressed - build a culture of knowledge sharing, show the upside, maybe introduce incentives (e.g., internal awards for those who put a lot into the database). All in all, the main concerns: data leakage, breach of confidentiality/RODO, AI failures or errors, and human resistance. All are valid, but all can be worked out. The worst thing would be to ignore these concerns - because then people will sabotage the implementation or be afraid to use it. It is better to discuss them openly and show what safety and ethical measures have been put in place. Then AI can be seen not as a threat, but as a new, safe member of the team (only that it is virtual).

Is it profitable for law firms to introduce AI for knowledge management?

This question boils down to evaluating ROI - whether the benefits (financial, time, quality) outweigh the costs and possible risks. There are many indications that yes, it is cost-effective, especially for medium and large law firms, where the scale of knowledge and repetition is large. There are costs to such an implementation, of course - software licenses or infrastructure, integration with existing systems, team training. But on the other hand, there are huge savings: lawyers spend less time searching for information, creating from scratch things that already exist, duplicating research, etc. According to some estimates, lawyers waste several percent of their time on administrative tasks and searching for information that a well-managed knowledge base could provide them. If AI cuts this even in half, we have, for example, 7-8% of work time to recover. In a legal environment, 7-8% more productive time is huge - it can mean, for example, an additional case handled or less overtime (which translates into employee satisfaction). AIMultiple mentioned in one report that more than 60% of lawyers admit they don’t use AI to its fullest extent, and 95% of those who do use it say it saves them time . In other words, the potential is there, and those who have used it see a gain. As for the hard finances: maybe it’s harder to count than, for example, document automation (where you immediately see a drop in craft hours). But an example: we won a case thanks to the fact that AI helped find a precedent from our old case that we wouldn’t have known about - that’s value, albeit immeasurable ex ante. Or we served the client faster, he was satisfied, gave further orders. Or the partner didn’t have to spend 2 hours explaining all the procedures to the new employee, because the chatbot answered most of the questions for him - the partner in that time can work on acquiring the client. These qualitative effects add up to a strengthening of efficiency and quality of service, which sooner or later has a financial dimension (better reputation, more orders from referrals, lower internal service costs). In addition, it may be that certain new services become possible - for example, a law firm may offer clients access to a certain Q&A database (with obvious confidentiality protection), or generate legal alerts for them more quickly. This can set it apart in the market. In an era when clients are demanding more and more for less (rate cuts, flat fees, etc.), internal efficiency with the help of AI is a way to maintain margins without sacrificing quality. Of course, this is sometimes seen as a cost and a big change at first. Therefore, in order to convince decision-makers, a business case like this is often drawn up: how many hours a year do we spend on X, how many would be left, how AI would cut this by Y%, how much an hour of lawyer work is worth - and out come concrete tens (if not hundreds) of thousands of zlotys in savings. In addition, Thomson Reuters noted that companies with an AI strategy in place are four times more likely to report benefits. This suggests that it pays to have a plan and invest. Finally, it can also be said this way: if we don’t invest and the competition does, they will be faster and cheaper - so our non-investment will pay off. That is, it pays off indirectly, because the lack of AI is an increasing opportunity cost. Bottom line: yes, introducing AI into knowledge management and internal processes is worthwhile, because it translates into time savings, better use of existing work, avoidance of errors, faster delivery of value to clients - all of which sooner or later shows up in a law firm’s bottom line and market position.
